MEDIATION: EFFICIENT, CONFIDENTIAL PROBLEM-SOLVING

 

     MEDIATION IS AN ALTERNATIVE THAT ENABLES THE CLIENT TO CONTROL THE OUTCOME OF A DISPUTE AND AVOID THE RISK, COST AND DELAY OF LITIGATION.

 

What is Mediation?

 

Mediation is a private, cost-effective way for people to resolve disputes without the use of litigation. Through mediation, parties can resolve their disputes privately by their own agreement. In this manner, the client can control the outcome of the litigation rather than rely on the decision of a third party. Mediation is also a tool which can minimize the risk, cost and delay of litigation. In mediation, the disputing parties meet with a neutral third person (the mediator) who facilitates a discussion about the dispute that enables the parties to reach an agreed resolution of the conflict. As part of the process, the mediator will conduct confidential settlement talks focusing on the disputed issues to identify the parties’ interests and generate settlement/resolution options.

 

When to Use Mediation

 

Mediation may be appropriate in conflicts where the parties will have continued involvement in the future, either personally or professionally, and also where both parties are willing to explore alternative means of resolution. Mediation may also be court-ordered in certain cases. The use of mediation in appropriate circumstances can reduce litigation time and expense. Mediation may be used in civil matters such as disputed estates and trusts, construction litigation, personal injury disputes, business/contract disputes and employment matters.

 

Mediation Services at Elliott, Trainor & Willman, P.C.

 

Both Ralph Elliott and Bridget Trainor have completed intensive mediation training through Northwestern University’s School of Continuing Studies. Ralph and Bridget continue with the traditional practice of law as their primary focus, but seek to resolve their clients’ legal disputes through mediation in appropriate cases. Bridget is an approved mediator for the courts of the Fifteenth Judicial Circuit in Illinois. Mediation is an alternative for those looking to resolve their disputes without protracted litigation.
